Smith Commc’ns, LLC v. Washington Cnty.
Smith sought a conditional use permit (CUP) to build a 300-foot-tall cellular tower on a Washington County site zoned "Agriculture/Single-Family Residential." There are homes within one-quarter of a mile of the site. The Zoning Code authorizes a CUP upon findings: That the proposed use is compatible with the surrounding area; will not be detrimental to or endanger the public health, safety, morals, comfort or general welfare; and will not be injurious to use and enjoyment of other property in the area for purposes already permitted, nor substantially diminish and impair property values within the area. The Planning Board approved the application. Neighbors appealed to the Quorum Court with arguments focused on "safety," "property values," the tower's "fit" with the area, proximity to their homes, and having purchased their homes specifically because of the surrounding scenery and views. Hearing participants discussed cellular phone reception; potential safety issues, particularly in inclement weather; proximity to residences; and impact on nearby residents' views and property values. The application was rejected. The district court and Eighth Circuit affirmed, rejecting arguments that Washington County failed to provide a legally adequate explanation of its reasons for denial and that the denial was not based on substantial evidence in violation of the Telecommunications Act, 47 U.S.C. 332(c)(7)(B). Donahue Schriber Realty Grp., Inc. v. Nu Creation Outreach
Plaintiff controls the Fig Garden Village outdoor shopping center, which has approximately 60 retailers. Plaintiff has a policy of prohibiting solicitation of donations on the shopping center property; it allows other forms of expressive activity, such as gathering petition signatures, in a designated public forum area only. Solicitors for Nu Creation solicited donations on sidewalk areas adjacent to the entrances of stores within the shopping center. Plaintiff explained its policy regarding solicitation and asked the solicitors to leave, but they refused. Officers would not arrest them without a court order. Plaintiff sought declaratory relief and a temporary restraining order. The trial court granted the ex parte application and issued a TRO. After a hearing, the court issued a preliminary injunction, which did not prohibit all solicitation on plaintiff’s property, but restricted it to a designated public forum area marked on a map attached to the preliminary injunction. T-Mobile South, LLC v. City of Milton, Georgia
This appeal concerned the City of Milton's decision to deny T-Mobile's applications for permits to build three cell phone towers. At issue was the writing requirement of the Telecommunications Act, 47 U.S.C. 332(c)(7)(B)(iii), which stated that "[a]ny decision by a State or local government or instrumentality thereof to deny a request to place, construct, or modify personal wireless services shall be in writing and supported by substantial evidence contained in a written record." The court concluded that T-Mobile had access to documents - including transcripts of the planning commission's hearings, letters the city sent to T-Mobile, and detailed minutes of the city council hearings- before its deadline for filing the lawsuit and collectively, these documents they were enough to satisfy the writing requirement of section 332(c)(7)(B)(iii). Interstate Outdoor Advertising, L.P. v. Zoning Bd., Twp of Mount Laurel
Interstate requested approval for nine outdoor advertising signs along U.S. Interstate-295, a major transportation corridor. The township then adopted an ordinance prohibiting billboards. The district court dismissed a constitutional challenge. The Third Circuit affirmed. A reasonable fact-finder could not conclude that there was an insufficient basis for the township’s conclusion that its billboard ban would directly advance its stated goal of improving the aesthetics of the community. The fact that Interstate will not be able to reach the distinct audience of travelers that it desires to target does not mean that adequate alternative means of communication do not exist. The Supreme Court has acknowledged that complete billboard bans may be the only reasonable means by which a legislature can advance its interests in traffic safety and aesthetics. T-Mobile Central, LLC v. Twp. of W. Bloomfield
T-Mobile proposed to build a cellular tower in an area of West Bloomfield Township, Michigan, that had a coverage gap. After deciding that sites in the township zoning ordinance’s cellular tower overlay zones were infeasible, T-Mobile decided that the best option would be to construct a facility at a utility site on property owned by Detroit Edison. The facility contained an existing 50-foot pole, which T-Mobile wanted to replace with a 90-foot pole disguised to look like a pine tree with antennas fashioned as branches. The township denied special approval. The district court entered partial summary judgment in favor of T-Mobile in a suit under the Telecommunications Act, 47 U.S.C. 332. The Sixth Circuit affirmed. Five stated reasons for denial of the application were not supported by substantial evidence and the denial had “the effect of prohibiting the provision of personal wireless services” in violation of 47 U.S.C. 332(c)(7)(B)(i)(II). Green Mountain Realty Corp. v. Leonard
Green Mountain owns cellular phone towers and leases space to federally licensed providers of wireless telecommunications services, who mount antennae on the towers to service their cellular networks. Green Mountain entered into an agreement with an agency of the Commonwealth of Massachusetts to lease land in Milton, an unzoned triangular section, approximately 2,700 square feet, formed by the intersection of I-93 and the southbound on-ramp. Applications to the Town Zoning Board of Appeals and the Milton Conservation Commission were denied. Green Mountain challenged the decisions as not supported by "substantial evidence," as required by the Telecommunications Act of 1996, 47 U.S.C. 332(c)(7)(B)(iii); as constituting an "effective prohibition" on provision of wireless services in the area in violation of the TCA; and as violating Massachusetts state law. The district court granted summary judgment upholding the denials. The First Circuit affirmed with respect to the substantial evidence claims, but vacated in part. The district court did not adequately address evidence supporting the effective prohibition claim.

Roundy’s, Inc. v. Nat’l Labor Relations Bd.
The company operates stores. The union was concerned about use of nonunion contractors who did not pay prevailing wages for construction and remodeling of stores. Unsatisfied with the company's response, the union urged a consumer boycott. Union representatives distributed handbills that were "extremely unflattering" outside the stores. Some pictured a rat to represent the company. The company ejected the representatives from the property. The NLRB issued a complaint alleging violation of the NLRA, 29 U.S.C. 158(a)(1), for discriminatory practice in prohibiting the union from handbilling while permitting nonunion solicitations and distributions. An ALJ found that as a nonexclusive easement holder at 23 of the stores, the company did not have a state property right to exclude handbillers, and had violated the Act. The Board affirmed. McMurray, et al. v. Verizon Communications Inc., et al.
Plaintiffs appealed from the district court's dismissal of their complaint against government officials and a group of telecommunications companies. Plaintiffs challenged section 802 of the Foreign Intelligence Surveillance Act (FISA), 50 U.S.C. 1885a, as an unconstitutional taking under the Fifth Amendment. Section 802 allowed the U.S. Attorney General to certify that a telecommunications company provided assistance at the behest of the government in connection with investigation of terrorism, thereby triggering immunity on the theory that application of section 802 required dismissal of plaintiffs' case and negated the cause of action under various federal statutes. The court held that the district court correctly dismissed plaintiffs' complaint for lack of jurisdiction where plaintiffs demanded no monetary damages. Marcavage v. City of Chicago
Plaintiffs, members of a religious organization, demonstrated around the stadium at which the 2006 "Gay Games" were held, but were prohibited from demonstrating and preaching on the sidewalk. They stopped demonstrating on the sidewalk outside a major tourist attraction (Navy Pier) under threat of arrest. One plaintiff, who refused to move from his spot on a public sidewalk outside one of the game venues, was arrested for disorderly conduct. The district court ruled in favor of the city defendants on claims under the U.S. Constitution, the Illinois Religious Freedom Restoration, and common law. The Seventh Circuit affirmed, except with respect to the First Amendment claim dealing with a policy requiring a permit for even small-group demonstrations outside Navy Pier. The constitutionality of that policy must be evaluated in light of the unique features of the location. MCI Communications Serv., Inc. v. Hagan, et al
Plaintiff filed suit against defendants, Wayne Hagan and James Joubert, alleging that Joubert was negligently excavating on a backhoe and severed plaintiff's underground fiber-optic cable in violation of the Louisiana Damage Prevention Act, LA. REV. STAT. ANN 40:1749,11 et seq., and that Hagan was vicariously liable because Joubert was acting as his agent at the time. At issue was whether the district court erred when it refused to give the jury plaintiff's proposed instruction on trespass. Also at issue was whether the district court erred when it excluded statements made by Hagan's attorney to plaintiff's employee under Federal Rule of Evidence 408; when it refused to certify plaintiff's witness as an expert; and when it held that defendants were entitled to attorneys' fees and costs. The court certified the first issue where the Louisiana Supreme Court had not previously determined what standard of intent was used for trespass to underground utility cables and the issue was determinative of whether plaintiff was entitled to a new trial on its trespass claim. The court held that the statements made by Hagan's attorney to plaintiff's employer could have been excluded on other grounds given that it was inadmissible hearsay against Joubert and therefore, the court declined to remand for a new trial on this ground. The court also held that the district court did not commit a reversible error where plaintiff did not proffer the substance of plaintiff's witness' excluded testimony. Finally, the court deferred addressing the attorneys' fees issue pending the Louisiana Supreme Court's decision on the first issue.
