Rio Vista Officer Collondrez responded to a hit-and-run accident. According to an internal affairs investigation, Collondrez falsified his report, arrested a suspect without probable cause, used excessive force, applied a carotid control hold on the suspect, and failed to request medical assistance. After hearings, the city agreed to pay Collondrez $35,000. Collondrez resigned. The agreement provides that Collondrez's disciplinary reports will only be released as required by law or upon legal process issued by a court of competent jurisdiction, after written notice to Collondrez. Penal Code section 832.71 was subsequently amended to require the disclosure of police officer personnel records concerning sustained findings of dishonesty or making false reports. The city responded to media requests under the Public Records Act for records, giving Collondrez prior notice of only some of the disclosures. Media outlets reported the misconduct allegations. His then-employer, Uber, fired Collondrez. Collondrez sued.The trial court partially granted the city’s to strike the complaint under California’s anti-SLAPP statute, Code of Civil Procedure 425.16, finding that Collondrez had shown a probability of prevailing on his claims for breach of contract and invasion of privacy but not on claims for interference with prospective economic advantage and intentional infliction of emotional distress. The court of appeal reversed in part, in favor of the city. The complaint arises from speech protected by the anti-SLAPP statute, but the trial court erred in finding Collondrez established a likelihood of prevailing two counts. View "Collondrez v. Bennett worked at the Metro Government Emergency Communications Center (ECC) for 16 years. On November 9, 2016, Bennett, a white woman, responded to someone else's comment on her public-facing Facebook profile, using some of the commenter’s words: “Thank god we have more America loving rednecks. Red spread across all America. Even niggaz and latinos voted for trump too!” Bennett identified herself as an employee of Metro, the police department, and ECC in her Facebook profile. A constituent reposted part of Bennett’s statement and commented: If your skin is too dark your call may have just been placed on the back burner. Several employees and an outsider complained to ECC leadership. Bennett failed to show remorse. ECC officials determined that Bennett violated three Civil Service Rules and, after paid administrative leave and a due process hearing, fired her.Bennett sued Metro for First Amendment retaliation. The Sixth Circuit reversed a judgment in favor of Bennett, finding that the district court improperly analyzed the “Pickering” factors. The record indicated that the harmony of the office was disrupted; the court erred in discounting the importance of harmonious relationships at ECC. It is possible that inaction on ECC’s part could have been seen as an endorsement of the speech and impaired future discipline of similar derogatory statements. It is also possible that a damaged relationship with her colleagues could affect the quality and quantity of Bennett's work. Bennett’s comment detracted from ECC's mission. View "Bennett v. Royal employed Kraft and Matthews (Defendants) in its sales team. Royal’s employee handbook prohibited using company equipment for personal activities; unauthorized use, retention, or disclosure of any of Royal’s resources or property; and sending or posting trade secrets or proprietary information outside the organization. Royal’s “GPS Tracking Policy” stated, “[e]mployees may not disable or interfere with the GPS (or any other) functions on a company-issued cell phone,” nor may employees “remove any software, functions or apps.” The Defendants resigned to become employed with one of Royal’s competitors. Royal discovered that, shortly before his resignation, Kraft forwarded from his Royal email account to his personal one quotes for Royal customers and Royal paystubs; contacted a Royal customer through Royal’s email server to ask the customer to send “all the new vendor info” to Kraft’s personal email account; then deleted and reinstalled the operating system on his company-issued laptop, rendering its data unrecoverable. Matthews did much the same and announced her resignation on social media, sharing a link to the song, “You Can Take This Job and Shove It.”Royal sued, citing the Computer Fraud and Abuse Act (CFAA), 18 U.S.C. 1030, which refers to one who “intentionally accesses a computer without authorization or exceeds authorized access, and thereby obtains . . . information from any protected computer.” The district court concluded that the Defendants did not “exceed[]” their “authorized access,” under CFAA. The Sixth Circuit affirmed. While their conduct might violate company policy, state law, perhaps another federal law, the employees were authorized to access the information in question. DISH sold its satellite TV service through its own staff plus third parties: “telemarketing vendors”; “full-service retailers” that sold, installed, and serviced satellite gear; and “order-entry retailers” that used phones to sell nationwide. The United States and four states sued DISH and four order-entry retailers. The district court found that the defendants violated the Telemarketing Sales Rule, 16 C.F.R. 310, the Telephone Consumer Protection Act, 47 U.S.C. 227, and related state laws. A $280 million penalty was imposed. DISH appealed concerning the extent to which DISH had to coordinate do-not-call lists with and among these retailers or was otherwise responsible for their acts.The Seventh Circuit affirmed, except for a holding that DISH is liable for “substantially assisting” Star Satellite and its measure of damages; those violations were essentially counted twice. Regardless of the definition of “cause” under the rule, which makes it unlawful for a seller to “cause a telemarketer to engage in” violations, the retailers were DISH's agents, regardless of any contractual disclaimer. They acted directly for DISH, entering orders into DISH’s system; they did not have their own inventory and were not resellers of any kind. The retailers were authorized to sell DISH’s service by phone nationwide; the district court found that DISH knew about these retailers’ wrongful acts, so DISH is liable as the principal. Harnishfeger published a book under a pseudonym, Conversations with Monsters: Chilling, Depraved and Deviant Phone Sex Conversations, concerning her time as a phone‐sex operator. A month later, Harnishfeger began a one‐year stint with the Indiana Army National Guard as a member of the Volunteers in Service to America (VISTA) program, a federal anti-poverty program administered by the Corporation for National and Community Service (CNCS). When Harnishfeger’s National Guard supervisor discovered Conversations and identified Harnishfeger as its author, she demanded that CNCS remove Harnishfeger. CNCS complied and ultimately cut her from the program. Harnishfeger filed suit alleging First Amendment and Administrative Procedure Act violations. The district court granted the defendants summary judgment. The Seventh Circuit reversed in part and affirmed in part. The book is protected speech; it was written and published before Harnishfeger began her VISTA service. Its content is unrelated to CNCS, VISTA, and the Guard. It was written for a general audience, concerning personal experiences and is a matter of public concern. A jury could find that Harnishfeger’s National Guard supervisor infringed her free-speech rights by removing her from her placement because of it. The supervisor’s actions were under color of state law, so 42 U.S.C. 1983 offers a remedy, and she was not entitled to qualified immunity. There is no basis, however, for holding CNCS or its employees liable. Harnishfeger failed to show a triable issue on any federal defendant’s personal participation in a constitutional violation. The Teamsters Union represents skilled crafts employees at UCLA and UCSD and was campaigning to unionize University of California Davis (UCD) employees. Teamsters distributed a flyer making statements about the impact that unionizing had upon the skilled crafts employees at UCLA and UCSD. In response, Regents distributed an “HR Bulletin,” stating: “the University is neutral on the issue of unionization” and that UCLA and UCSD employees had been in extensive contract negotiations, which had the effect of freezing salaries for several years. The flier included favorable statements about UCD salaries, benefits, and grievance procedures. Teamsters filed suit, citing Government Code 16645.6, which prohibits a public employer from using state funds to “assist, promote, or deter union organizing.” Regents filed an "anti-SLAPP" special motion to strike (Code of Civil Procedure 425.16) arguing that the complaint arose from protected conduct: a statement made in a place open to the public in connection with an issue of public interest; that Teamsters could not demonstrate a probability of prevailing on its claim because the action was preempted by the exclusive jurisdiction of the Public Employment Relations’ Board (PERB); and that nothing in section 11645.6 prohibited noncoercive speech. The court of appeal affirmed the denial of the anti-SLAPP motion. PERB had exclusive jurisdiction over unfair labor practices. The bulletin was not alleged to be an unfair labor practice. The bulletin could be construed as an attempt to influence the employees, so Teamsters had a reasonable probability of prevailing on its section 16645.6 claim. View "Teamsters Local 2010 v. Sensabaugh, the former head football coach at David Crockett High School in Washington County, Tennessee, made two Facebook posts expressing his concerns about the conditions and practices of schools within the District. The posts included pictures of students. Sensabaugh refused to comply with requests to remove the posts and became aggressive with his supervisors who noted other alleged misconduct, including his use of profane language with students and his requiring a student to practice while injured. He was fired after a guidance meeting where his conduct caused his supervisor to report her concern “that Sensabaugh posed a threat to the safety of the students and staff.” He sued, raising First Amendment retaliation and municipal liability claims. The Sixth Circuit affirmed summary judgment in favor of the defendants, finding no causal connection between Sensabaugh’s Facebook posts and his termination. A thorough independent investigation preceded Sensabaugh’s termination; that investigation concluded that the misconduct allegations were substantiated in full or in part and that the misconduct supported termination. Chicago’s Independent Police Review Authority (IPRA) investigated complaints against police, including domestic violence, excessive force, and death in custody, and made disciplinary recommendations: allegations were “sustained,” “not sustained,” “exonerated,” or “unfounded.” Investigators interviewed witnesses and procured evidence to draft reports. IPRA’s Administrator retained final responsibility for making recommendations and establishing “rules, regulations and procedures for the conduct of investigations.” Davis became an IPRA investigator in 2008. Davis alleges that in 2014-2015, his supervisors ordered Davis to change “sustained” findings and make his reports more favorable to the accused officers. Davis refused and was allegedly threatened to with termination. Davis alleges that they requested Word versions of Davis’s reports to alter them to look like Davis had made the changes. The administrator then implemented a policy requiring his approval for all “sustained” findings: if an investigator refused to make a recommended change, he would be disciplined for insubordination. Davis again refused to change “sustained” findings and was fired. The Seventh Circuit affirmed the dismissal of his First Amendment claims. That an employee may have good reasons to refuse an order, does “not necessarily mean the employee has a cause of action under the First Amendment when he contravenes that order.” Because IPRA required Davis to draft and revise reports, his refusal to revise those reports was speech “pursuant to [his] official duties.” He spoke as a public employee, not a private citizen. In 2008 Oncor began installing smart meters that can report customers’ electricity usage remotely, eliminating the need for personal inspection and the associated labor costs. In 2012 a Texas Senate committee investigated whether smart meters have harmful effects on public health.” Reed, an Oncor “trouble man” who completed ad hoc repair jobs and responded to power outages, who was also the union's business manager and financial secretary, volunteered to testify. Reed signed the witness list as representing the union. During his brief testimony, Reed said he represented the local union and spoke of the meters burning, testified to receiving repair orders or damaged boxes after the meters burned, and spoke of experiences with disgruntled customers. Oncor investigated, concluded that Reed’s testimony was false, and terminated his employment. An ALJ found a violation of the National Labor Relations Act by interfering with Reed’s protected union activities. The NLRB affirmed. The D.C. Circuit remanded, directing the NLRB to clarify its decision under a two-prong test for assessing whether employees’ third-party appeals constitute protected concerted activity or amount to such detrimental disloyalty as to permit termination for cause. Even disparaging statements can enjoy protection where the communication indicates it is related to an ongoing dispute between the employees and the employers and the communication is not so disloyal, reckless or maliciously untrue as to lose protection. Connecticut General Statute 52‐59b, which provides for long‐arm jurisdiction over certain out‐of‐state defendants except in defamation actions, does not violate plaintiff's First or Fourteenth Amendment rights. This case arose out of a news article published by Bloomberg News, reporting a lawsuit filed by plaintiff against his former employer, Palladyne International Asset Management, and others. The Second Circuit affirmed the district court's dismissal of plaintiff's defamation action as to the out-of-state defendants. In regard to allegedly defamatory statements made by the remaining defendants, the court affirmed the district court's dismissal of plaintiff's defamation claim based on the "as much as $500 million" statement, and reversed the district court's dismissal of the defamation claim based on the "repeatedly tried to extort" statement, pursuant to New York Civil Rights Law 74.
