Marcavage v. City of New York

Two protesters at the 2004 Republican National Convention at Madison Square Garden were arrested after they failed to comply with police instructions to move from an area where demonstrating was prohibited to one designated for protesting. They sued under 42 U.S.C. 1983, alleging that the policy violated the First Amendment and that their arrest violated the Fourth Amendment. The district court entered summary judgment in favor of defendants. The Second Circuit affirmed.
